Terms of service — SolarGPU inference API

1. Parties and purpose. Acceleration Robotics S.L.U. (SolarGPU brand), Spanish tax ID B01952092, registered office in Vitoria-Gasteiz, Araba/Álava (Spain) ("SolarGPU"), provides the customer ("you") with a service for running open-weight artificial intelligence models accessible by API (the "Service"). By using an API key or accessing through an intermediary platform you accept these terms.

2. What the Service includes. OpenAI-compatible API access to the models published at https://api.solargpu.es/models, with the context, parameters and capacity limits stated there. Models, their versions and their prices may change; changes are published at that same address and apply to subsequent requests.

3. Price and billing. Billing is per token processed, at the per-model price published at the time of each request, in US dollars or euros depending on the channel. Intermediary platforms are invoiced monthly; direct customers in advance via balance or monthly by bank transfer. Prices exclude VAT.

4. Availability. SolarGPU provides the Service diligently with a monthly availability target of 99 %, with no service-level guarantee unless agreed in writing. There may be maintenance windows, announced in advance when possible. Under load the Service returns code 429 instead of queueing requests.

5. Acceptable use. You may not use the Service for illegal activities, to generate content that infringes third-party rights, to deliberately attack or overload the infrastructure, to circumvent capacity limits, or to extract, resell or impersonate the Service without agreement. SolarGPU may suspend keys that breach this section, giving notice when possible.

6. Data and privacy. Data processing is governed by the Privacy and retention policy published at https://solargpu.es/en/privacy: the content of requests and responses is not stored, is not used to train models, and all processing happens in Spain. You are responsible for the content you send and for having a legal basis to do so.

7. Third-party models. Models run under their public licences (Apache 2.0, MIT, Llama or others), which bind you insofar as they apply to you. SolarGPU is not the author of the models and is not liable for their outputs.

8. Ownership. Inputs are yours; outputs generated for you are yours to the extent the law allows. SolarGPU retains ownership of its infrastructure and software.

9. Warranties and liability. The Service is provided "as is". To the extent the law allows, SolarGPU's liability towards you is limited to the amount paid for the Service in the three months before the event giving rise to it, and excludes indirect damages and loss of profit. Nothing in these terms limits liability for wilful misconduct or personal injury.

10. Term and termination. The Service has no lock-in. Either party may terminate it at any time; SolarGPU will do so with reasonable notice except in case of breach. On termination, the tokens consumed are invoiced and the keys are revoked.

11. Changes. SolarGPU may modify these terms by publishing the new version at this address with its date; material changes are communicated to direct customers 30 days in advance.

12. Law and jurisdiction. Spanish law. For consumers, the courts of their domicile; for businesses, those of Vitoria-Gasteiz. Version 1.0, 10 September 2026.
